1. From our search of the New Zealand Financial Service Providers Register (FSPR) First Excelsior is registered to provide a number of financial services, seehttp://www.business.govt.nz/fsp/app/ ... eturn=true. By way of background, financial service providers with a place of business in New Zealand are required to register on the FSPR in order to legally conduct business. The register is not a list of the individuals and entities that FMA regulate. While the registration process ensures certain people cannot be involved with the provision of financial services, for example those people who have specific criminal offences or who are un-discharged bankrupts, there are no checks around competence, qualifications or good character.

2. FSCL refers to Financial Services Complaints Limited which is a dispute resolution scheme (DRS). Financial service providers who provider services to ‘retail’ clients must be a member of a DRS.

3. We note that this entity’s website contains a statement that First Excelsior ‘falls under the authorization, enforcement and supervision of the Financial Markets Authority’. To be clear, although this entity is incorporated in NZ, registered on the FSPR and a member of a DRS, this entity’s business activities are not authorised or regulated by the Financial Markets Authority. We note this entity’s website states that it is licensed and authorised to offer futures and options products. Anyone who deals in ‘futures contracts’ in NZ must be authorised by FMA and I can confirm that First Excelsior is not authorised by FMA as a futures dealer.

4. We always advise investors to conduct their own due diligence in respect of any entities they are unfamiliar with, especially before handing over any money.

Good homework on the previous posting. We were approached in Europe about this group and always being skeptical decided to do some of our own research. While FEX has offices in New Zealand, their jurisdiction is in the Netherlands Antilles, specifically Curacao, a constituent country of the Netherlands. Checking the records there, First Excelsior Limited "allows credits and invests its resources in securities and deposits and gives (sub) licenses for the use of intellectual and industrial owner rights under the law" The entity is regulated by the Central Bank. Records also show a legitimate presence in the British Virgin Islands, United Kingdom and the Netherlands. From what we can ascertain, FEX does not occupy itself with any type of retail business nor deals in commodities, futures, options etc. This was indicated in the previous posting and the inquiry in New Zealand. Instead we received positive confirmation that FEX is exclusively focused on currency. Their claims of having a Prime Brokerage relationship with Rabobank (RaboGroup) is legitimate and has been verified. In addition, as mentioned on their website, the relationships with Currenex and Hotspot are true also. While they have a SWIFT membership, it appears most of their business is done in correspondent prime banking relationships. Nothing new there, as all banks are obligated to have correspondent relationships if they want to deal in currency. We tried to figure out what the Earthport relationship was and contacted them in the United Kingdom. Think of Western Union but more sophisticated.. It's a great service that we were not even familiar with before we checked into it. We are still hesitant regarding the fact that FEX is a young institution (less than 2 years) but they have great credibility by virtue of the relationships they have obtained. We found no complaints, legal cases or legal actions of any kind so the benefit of the doubt clearly applies here. Regarding ownership we found several roads all leading back to the Netherlands and Mr. Nick VandenBrekel as Manager. Further checking into his background shows a serial entrepreneur with significant global experience in a variety of industries. No surprise he is a Dutch native. He has confirmed relationships within the sports world, agricultural industry, energy and high tech. Not sure about the degree of his success or net worth but he is an engineer / scientist with a military background.

All I would say is that it isn't a bank and it doesn't claim to be one.

It's existence in the UK began in September of last year and it has not specified the nature of its business in its Companies House registration.

Bank regulation in Curacao and the Netherlands are very different, but the company isn't a bank and the website states that "Any references on this Website to Excelsior are references to First Excelsior Limited." which is based in the UK or BVI or NZ.

First Excelsior Limited (FEX) is a financial services provider, offering depository services on behalf of its clients.


Wouldn't that be 'to' its clients ?

First Excelsior Limited B.V. NA allows credits and invests its resources in securities and deposits and gives (sub) licenses for the use of intellectual and industrial owner rights and equal kind of property rights or user rights under the law.


I haven't a clue as to the relevance of this statement, and nowhere is there any mention of the applicable law and legal jurisdiction involved, which is significant with there being 6 possible countries involved.

Actually there isn't an address here for First Excelsior Limited (FEX).

who are stated to be the 'financial service provider'. If (FEX) is some abbreviation for one of the companies this should be specified, otherwise it appears to be another company. Using the name and an abbreviation together, if that's what it is, creates uncertainty. If it's First Excelsior Limited, presumably it's located in BVI or NZ, so regulation in Curacao would not serve any useful purpose.

These are merely observations.
