i also gave had a run in with these guys i was denied a loan i never signed any papers or loan agreements
nothing i got and look into my account and these guys tool 111.00 out of my account
i never signed a PAD agreement, and on top of it all theres no way of contaxting these ppl
now im in the whole 150 what the hell how can they be getting away with this!?

I have also been scammed by Upper Canada Loans. Thank goodness it was just over one hundred, but that money mine. They unauthorized took the money from my savings account. The ink had not even dried, when I found this site. I banged my head against the wall several times over this blunder.
I went to the bank with this info, and received the money back. They also started an investigation against this company. After numerous attempts to get answers, via my email, demanding my money back. I never did get an answer until I told them I was opening up an investigation. Then they sent me an email from some guy offering me the money. These people are thieves. I hope anyone who is contemplating getting a loan from this fraudulent company, see's this site first.

I forgot to add in my last post that after this mess, I had to change all my accounts so they could not take anymore money from my account. There was a lot of work involved doing this. I was not going to say anything at first, due to embarrassment, but I could not stand by and let this happen to other innocent people.

Luminous Financial Takes it from EFT CANADA- EFT CANADA gets it from UPPER CANADA
Luminous Financial said they will call EFT to contact me and I asked for the number but they wouldnt give it. for EFT or Upper Canada. They said theyve had this problem before.
I told them they have until noon to get back to me.
I will keep you posted on what happens.
I work for Corrections and used that to threaten them...the guy seemed sketchy on the phone

Just noticed in my account they took money from my account too. $111.58. I remember looking at their site but was sketched out by it and they still got me. Kind of wonder if it would be worth looking into a class action suit. Bunch of us get together and sue the pants off them. It isn't alot of money but I still can't afford it with 6 kids to care for, and having rapidly progressing MS to boot. I am going to call my bank tomorrow and raise a bit of hell, and I sent them a nasty email, think tomorrow I may try calling them too. Would like to know if anyone else is interested in suing them, or at least as a group calling them out on this crap.

I must point out that I am not legally trained and have no knowledge of Canadian law, so you must not treat anything I say as legal advice, however I may be able to point you in the right direction for further investigation and action.

I doubt that a class action law suit is the way to go, and in the area of lending companies or loan brokers, if they are actually an authorised and regulated company, will be covered by state and federal law.

The first thing to do is establish some facts and, if there is a link to anything on the internet which sets out the details and terms of the deal that was agreed with you, it would be helpful. I don't need to know, or want to know your personal details, just the terms and conditions that apply to your agreement. This will often appear somewhere on the internet and you may have used a specific website and it would be useful to know the website you used.

Some things to establish.

Did you receive the loan ?

Is the company acting as a primary lender or broker and what are these charges and where are the details of what they are and how they're calculated set out and were these communicated to you ?

I'll see whether or not I can work some of this out for myself, but however you decide to deal with the matter, it's going to be useful to get these things established at the outset.

Seems easy so far

Please carefully review any loan offer you receive, including its terms, and rates. Then if you are satisfied with your loan offer including the fees to be charged to you, you may proceed by accepting the offer.

Presumably Luminus Financial is the lender

.. and they look above board, so the basic question is what's gone wrong ?

Did you receive the loan ? - and who from ?

The process involves establishing the facts and what happened, also whether they acted in accordance with their published procedures and fulfilled their legal obligations to you and complied with state/federal law. If it can be evidenced that they have not complied with their obligations, then you can decide what action to take and will be in a much better position to proceed.

I didnt' actually apply for a loan. I did not ask for, or recieve any money from them, did not talk to anyone, I got one email that I read and then deleted. They still have access to my account and according to my bank they have a "scheduled withdraw" set up. There are literally hundreds of people here in BC that have been scammed by them. There is no office, no working phone number and seems to be no person you can talk to about your loan or lack thereof. So what? Just let them take money monthly? Change all my banking info? I have payments to companies that come out monthly, it would litterally take me months to get all this changed, and it would be costly.

I don't know how the payments system works in Canada, but the only way this company could be debiting money from your account is if you gave them sufficient details to do so (either bank details or card details).

So, if all you did was read and then delete an email, how were they able to get these details and why are your bank not treating this (and the pending payment) as fraudulent transactions.

Please do not tell scammers that they are listed here - it will take them seconds to change their fake details and their new details will not be listed for any future victims to find.

As AJ suggests, the simple solution is to instruct your bank to reverse the charge to your account. Whoever originated the transaction then has to evidence that they hold your authority to make the charge or take it back, effectively put up or shut up.

It is possible for organisations to originate such charges and payday loan companies in the UK frequently use them. Rather like a merchant trader facility a finance company allows them a facility and undertakes to make refunds in response to mistakes or fraud. On one occasion such a company in the UK was originating charges to people's accounts in response to fraudulent applications by criminals and they didn't hold any proper authority. There was quite an uproar and the company folded, after all victims had been refunded.

The circumstances were daft as the pdlc was accepting ID details anyone could get hold of, and to compound matters, was then sending the money to a different account to the one they were charging.

I can't say that this is what happened in your case, but it has similarities. However in any event your primary recourse is to your bank who must justify why this charge has been placed to your account. If they can't, they must reverse it.

Don't be rude to your bank, but be firm.

Don't go chasing after companies you know nothing about and with whom you have no relationship. Your bank allowed the charge, it's for them to clear it up and obtain reimbursement if it's unjustified.

It's a bit of bugbear with me that simply knowing someone's account details doesn't give them the right to pass a charge. If you could, with my background in banking, I'd be a multi-millionaire. Anyone you give a cheque knows your account details and has a specimen of your signature too, but think of how many utility companies, shops, catalogues, local tax offices hold this information.

Merchant trader facilities and other similar arrangements should only be given to very reliable and trustworthy companies, because the implications for those that hand them out can be catastrophic if they're misused. I've come across instances in the UK where the system hasn't been properly operated, but the companies involved learn a painful lesson.

I note that you have a Banking Ombudsman service in Canada. :D

I must make it clear that you complain to your bank about the unauthorised charge to your account. If they don't reverse it, then you go to the Ombudsman but follow the steps they lay out. The bank allowed the charge. It's their responsibility. When you first mention that you want the charge reversed (be polite but firm) mention that you will refer it to the Ombudsman if it is not resolved.

Any other victims should do the same. A company that has been doing this a lot will find their facility and ability to originate account charges will go up in flames if faced with a lot of reversed charges.

Just to be certain - they didn't use your debit or credit card to charge you did they ? From what you say they didn't, but if they didn't and you didn't authorise a charge, instructing your bank to reverse it is the way to go.

Even if you did, it doesn't close your options, but just alters them. I mention this for others who may have been affected.

People need to STAY AWAY from this site mentioned. They are an organization of nothing but scammers. I as well have fallen victim to these people, making the mistake of issuing them a PAD from my bank for my monthly repayments for the loan I was supposedly approved for. After being contacted by an "Agent" asking that I submit a proof of funds first before they make the deposit of the loan in to my account which struck me odd, I did a little research on this and found that they were already reported a scam by numerous amounts of individuals on the web. They operate under a few different names, one I know of is Capital Finance Company. Their site is and these are the individuals doing all of this. Read the reports by BBB, they to are having issues getting legitimate information from these people. As of this morning they tried to withdraw $200.00 from account and are now being investigated by my bank and authorities. Please people, STAY AWAY from that site.

Just want to confirm this company is still in business. I am now in the fight for my life to avoid eviction from my home due to a charge from these guys. I have called my bank and the police anti-fraud department in my home town, and I am told it can be up to 2 months before any charges are reversed and that is pending on the outcome of an investigation. I hope no one else falls pray to these guys. I also hope they caught soon too. Lowest of the low scamming people that are already in a time of need. Robbing from the poor are you kidding me.

For all of the questions I have seen on here, the most common question asked.

Q: "Did you receive your loan?"

A: No, I was sent an email saying "Sorry, I did not pre-qualify for a loan at this time."

2 weeks later my bank account was debited.

The day after my account was debited, I was sent an email from someone saying he is a private lender from Upper Canada Loans and wanted to give me 5000.00!!! and when I looked at this "new" application it looks like it was made up on a windows paint program, asking for ALL kinds of personal information. I have saved this email and submitted it, along with all my evidence to the police anti-fraud department.

I only needed to borrow just 100$, its now going to cost me over 250$ plus the missing 100$ that I really needed.

Recently dealt with this company. They now go by 7940696 Canada Inc.
(DBA I wasn't aware there was an upfront "finder's fee" and they debited my account for $145.99 CAD. Thankfully, my bank was able to get that money back for me, but a lot of people aren't that lucky.

If you come across this company, PLEASE do not apply with them. They have no phone number, and apparently mail that was sent to their business address in Ottawa was Returned To Sender as of September 2019.
